I have a friend who knows she is unable to care for her baby. She asked me if I could take custody of her baby. She wants to terminate her parental rights and give me custody that way. Is it possible? How do I go about doing that?
There are only two ways to terminate parental rights in Arkansas: (1) DHS action or (2) adoption.
Your only option is adoption, if you must terminate her parental rights.
However, you could file a petition for guardianship and she could consent to it.
It will not terminate her parental rights, but you would be the legal guardian (if qualified).
You would be caring for and making all decisions for the child, etc. similar to a parent.
BUT, mom could revoke consent at any time. If you wanted to fight that and keep the guardianship, you would have to prove in court that she is not a fit parent.
