I was fired for suspected theft. They said in my final meeting that they had it on camera and then kept my last paycheck which was well over the amount I was accused of taking and no camera or other evidence was ever shown to me. Now that I’m trying to get my 401k distributed, the owner of the company who is also the 401k plan administrator, is refusing to send in my signed distribution request. She stated they are doing a full audit and she won’t send it in until they find out if there is more money that is missing that they would blame on me (I recorded this phone call). Can she do this? I’m about to go into foreclosure on my house and the 401k is all I have coming to save our home. What can I do, if anything? No police have been involved in any of this as of yet. Even if I did steal something would this be legal? Just seems so unbelievable..
