My employer recently said that if any cars get returned bc the customer isn’t happy, he would reduce our pay. Today he said he is going to start reducing our accumulated PTO time for returned cars. I work in at an Auto Collision Center. Cars get returned if they feel their car is still not running correctly or it’s not up to their standards. Can my employer do this? Also he already doesn’t pay us our full hours if he doesn’t have a “good” week. Is that legal?
He can cut your pay anytime he wants, as long as it is $7.25 an hour unless you have a contract with him for a different rate. Or a promise of a rate.
I'm not sure what "accumulated" paid time off is. But I have an idea. If it is a way around overtime that is illegal. If you work 45 hours in a week, they have to pay you that overtime. They CANNOT give you 5 hours of "comp time." ILLEGAL. Big fines. and damages for you.
He has to also pay you for every hour you work. NO if's and's or but's. ILLEGAL. Keep a journal in ink of each week and how many hours you work each day and how much you are paid for.
You are employees? and not contractors. That is you get paid with a W-2 and they take out taxes and social security and medicare...... If not that is illegal too.
