I recently asked for a modification on my child support and the courts agreed to give me an increase. Now the father wants to hold the insurance to lower his payments. Its a safety concern for me. The Kansas Child Support Guidelines are available on the internet at http://www.kscourts.org/Rules-Procedures-Forms/Child-support-guidelines/2016-guidelines.asp. I suggest that you look at the Clean version. The part of the guidelines dealing with health insurance in on page 17.
It is very unlikely that if health insurance is available that your child will be allowed to remain on medicaid.
You should note that it is possible to submit health insurance claims directly to the company or self insured EURISA plan without contacting the child's father.
You should also note that if the father is a danger to the child, it is possible to sever his parental rights. However, under Kansas law, if his parental rights are severed he would no longer owe future child support. If you are on welfare, DCF would be a necessary party to the severance action.
