My boyfriend and I just had a baby. He has a son with his ex-wife that he pays child support for based on his custody percentage and income. If I am claiming our daughter on my tax return (therefore he doesn't claim any children since his ex-wife claims their son) then is he still allowed to have his child custody payment lowered?
If BF paying court ordered CS for second child, he may claim the expense for purpose of computing CS obligation.
It can be slightly lowered IF he provides actual support for the baby he and you have together.
