An father of a child who is not married to the mother has no legal rights whatsoever until he establishes his paternity by court order. That petition could possibly be rejected by the court as premature if filed before the birth, but that petition could be prepared and ready for filing on the day of birth. In the meantime, the father should register his claim of paternity with the Idaho Putative Father Registry through the Vital Statistics Unit of the Idaho Department of Health and Welfare. The petition to establish paternity can also request a decree of parental rights, where both joint legal and joint physical custody is favored and neither parent's rights are superior to the other's in consenting to adoption.
