My daughter got her green card at 9 years old i was not aware it had to be replaced on or before her 14th birthday. we have to travel urgently however her green card won't expire until 2020 would I encounter problems returning? I am a citizen and applied for a passport for her however I need custody papers hence her travel.
If you don’t have custody and approval from the other parent you cannot travel at all as you can be charged with kidnaping.
You have to be allowed foreign travel either in your parenting plan during vacation or you have to obtain notarized consent.
Also you need consent to get passport.
You cannot use foreign passport to substitute consent.
Also, the green card is not a passport and you cannot travel with it. You can only use green card to reenter US. they will not let you fly without a child’s passport and if your spouse reports you. You would be arrested. This is a federal crime to take a child without the other parent’s consent.
Only with the notarized, written consent from the non-custodial, non-traveling parent. Otherwise will not be able to even check-in to the flight.
