Wife and I have been separated for approx. A year. During separation she lived with a guy who has done time for murder and who is an IV methamphetamine user. He never hurt my daughter as far as I know, however has several counts of domestic from other states and recently against my wife numerous times. Well I got them out of there. Stayed with my mom... Wife and I have a rough past as well... Evictions, lack of employment, I have 4counts of domestic violence and wife lost 6 yr old to X last year while locked up on drug paraphernalia charges. So these things will be used against us i know. My mother made my wife and daughter leave today with nowhere to go she went Back to HIS house. Now my mother is saying she will hire an attorney to take custody of our 3 year old little girl. Is this feasible in the state of Missouri.
If Missouri is like most states your mother would be entitled to seek placement of the child but only if you agreed or she was able to prove that you and your ex (the child's mother) are unfit. She should talk to a lawyer about this. You should also talk to a lawyer as well.
More facts are needed to be able to give you legal advice, such as: what is the disposition of each of your and your ex's criminal cases; how long ago were your last charges; are you or your ex currently employed; how long has your ex been away from her boyfriend; which court was the divorce decree entered; how long ago was the divorce decree entered etc.
