This happened on a military installation. I am the service member. My ex was abusive and I asked my sergeant to take me to the MP station. I was told to make a report I had to sign a document saying that I allowed. I wrote my report. I was never told I was arrested or detained. After the military did an investigation no charges where filed against me. Everything disappeared. I never received any paperwork about the incident from the MP. I went to file an cilvian order of protection against my ex. And was granted an indefinite order of protection. My ex was barred from post for domestic abuse. This all happened two years ago. Now the military police are saying that night I was arrested and they need a DNA sample. That they are following Lousiana state law. What are my rights and how can I get this off my record?
You need to consult with a criminal defense attorney who is also knowledgable about military law.
