My son is 39 yrs old. He's being living with me for several yrs without having any responsibilities but his own. I've ask him to move out, but he refuse to do so. I've talked to him about, given him two months, two weeks and he still refuse to leave. What should I do?
Yes, you can.
Provide a written three day notice to vacate to your son. Keep a copy. If your son does not vacate, you can file an eviction petition in justice of the peace court, and arrange for service on your son. If need be, the court will set a hearing on your petition. If you prevail, the justice of the peace will order that your son vacate within five days. The order can be served by a Constable.
