I received a 3 day notice on my door today for 3810.33, however I have paid my rent back in March my complex tried to evict me and i had the rent ordered to pay by the judge. The landlord lawyer said they'll call me to set an arrangement for the late fees and attorney fees to be paid in some type of payment plan but never called. Can the convert those fees into rent for the documentation of a 3 day notice or is this illegal
This depends on the terms of your Lease, and whether it defines these items as "rent" (many, if not most, do) or, if the Court Order requires it to avoid the previously filed eviction - neither of which we can review here on line. You REALLY should have PAID those fees (or called THEM!) and now, you REALLY should have good a good local tenants lawyer representing you; you can't get advice for specific litigation here.
Hope this helps.
Responses provided herein are merely commentary on the question posed. They are NOT intended as legal advice, nor to create an attorney-client relationship between you and I; and all askers should consult an attorney for advice regarding each individual matter, since each case is a bit different, and not all information is typically recited in the online question as posted. PLEASE do not contact me directly; I am NOT accepting new clients at this time, and only volunteer here on AVVO to "give back" after a long and prosperous career. Good luck!
