I entered the US in Mar,2016 with my H1 B visa (which was valid until July 2016).
My employer subsequently filed an extension while i was in the US and the extension was approved with a validity starting May 2016 and ending May 2017.
I switched employer and got my H1 B transfer approved with the same i797 validity end date.
My new employer filed an extension in Feb,2017 which was approved a few days ago (premium processing) with a validity start date of May 2017 and ending on May 2018
I plan to visit India in two weeks and need to get my visa stamping done prior to return.
Question: Can I use my latest I 797 with a validity start date of May 2017 or will i have to get my visa stamping done with my current valid I 797 (valid until May 2017)
This is a bit of a mess.
Which employer are you working for at this time.
If you get a stamp for the new employer, you can't enter the US until 10 days before the May 2017 start date.
Talk to the lawyer that did the new papers. If he/she is unavailable, make sure you talk to one of the other lawyers in his/her office ... don't waste time talking to NON-ATTORNEYS in HR.
