I have a tenant who is on a month to month rental agreement been in my place for 4 years whom has breached the rental contract by holding rent when a repair arises. Recently, i increased the rent set for March 1st and now the tenant wants to purposely break things and call for repairs. Now the tenants is holding rent due to a ceiling fan repair that they broke. I just want this tenant gone . How long in nys can i provide a terminate tenancy notice?

More information about the rental agreement would help. There is no shortcut to the 90 day tenancy termination notice. But you could bite the bullet and commence a nonpayment proceeding. You are going to confront the tenant likely claiming a retaliatory eviction no matter what proceeding you initiate. If you dispose of the defense in a nonpayment proceeding that would boost your chance to succeed in the holdover if the tenant was not already evicted.
