You would have to find out who the driver of the tractor was and was he working for someone. You'll also have the burden of proving that person's id and liability. You should have immediately pulled the tractor over, exchanged information and called law enforcement.

I agree with the other attorney. At this stage of the situation, it would be your word against the driver of the tractor assuming you can find the driver and the tractor. You would also have difficulty retaining an attorney because the physical damage does not allow for a contingency contract to be effective for representation. In other words, there is simply not enough damage for an attorney to take the case on contingency. You would have to pay someone by the hour.
