Me and my Ex Wife have been divorced for about 6 months now, we no longer have any way of contacting each other, however, she has the car from the marriage, which is only in my name. Seeing as I'm obligated to pay the car payment (there was no court order dividing property or debt) can I take her off my insurance, since the car itself is still insured under my name? Thanks for any help!
This is a good question for your insurance agent. However, if you take her off the insurance, it seems like all you do is subject yourself to liability if she is involved in an accident. It is your car, and you have liability. Why not just find your car and do with it what you please? Given that the divorce is done and you and she have not deemed it advisable to do anything formal about your assets and liabilities, title rules. If you decide to take possession of the car, do nothing to breach the peace as you could be subject to arrest.
