I moved into my apartment in June and paid first last & a security deposit. I had a roommate for about a month but she broke too many rules and ended up leaving. I found another roommate, all he had to pay to move in was the month's rent. No deposit or anything. My property manager was cool about it. He bailed a few months later even though he signed the lease to stay until the following June, and in turn I ended up losing out on not only my home but my $615 deposit that I would have gotten back if we rode out the lease for another 6 months. I couldn't find another roommate and couldn't afford paying rent on my own. He said he would pay me the deposit and I have messages proving it. But he's being very condescending and dodging me. What can I do legally? I don't want to take him to court if I don't have to but if I have rights and can threaten it then I will do so.
The security deposit is left with the landlord so that should there be damage to the property, then that security can be used by the landlord to pay. It sounds like you were the only person responsible for paying it and had control over the premises so as to fix the place up. I don't think you have any recourse against the second guy.
