I went in for a trigger point injection- given steroid shots instead (temp dr that day didnt know how to administer trigger point) within mins after steroid shot I had reactions— bad bad headache and bones felt like they were on fire. When nurse came in I advised her I was worse than before shot — she refused to treat me and said I was breathing fine—- sent me home. Called back later to advise not doing well — was refused when asked to speak to nurse or doctor and told to go to emergency. Went to another facility was treated for reactions from steroid reactions, missed business trip and week of work. Filed claim w company with very detailed along w other facity notes on treatment. Was only seeking my losses — denied because doctors care did not agree with the treatment the other facility used to treat their screw up. I lost a week of wages/vacation and travel costs plus extra medical fees. Can I take them to small claims court?
Medical malpractice, which is what you are describing, is not really suited for small claims court. You need a medical doctor to state that the treatment you originally received fell below the standard of care. That is too expensive and complicated for small claims.
