I have legal guardianship of my little brother. I have Court in two months because I petitioned the court to allow me to relocate to another state. However there has been an emergency to where I have to go out of state for almost 2 months but will return for court. Can I take him with me to deal with this emergency? I have no one else that can watch him while I am gone. We would have to transfer him to another school in the mean time so he can continue his schooling there.
I'm at a loss here been waiting already 2 months for court and life happened and I'm stuck. What should I do. Any advice would be helpful.
You need to look at your court orders. If you must go immediately, you may want to hire an attorney and file an Ex-Parte motion to get in front of the court sooner.
Possibly. Multiple factors affect right of guardian to remove child from jurisdiction:
-court appointment order;
-impact on visitation reights of other parties
If orders unclear and urgent need to travel out of state, your attorney my file ex-parte petition for authority to move child to another state.
