Pizzeria messed up my order and I asked nicely to re make my correct order and they lashed back with attitude and disrespect and ended up making a pizza with "poison" in it that messed up my entire family's stomach.
That is a criminal statute. Only the government (the prosecutors office) can file criminal charges. You can file a police report and they will investigate and forward it to the prosecutors office for review and possible filing charges.
Realistically, unless you have concrete evidence there is going to be no way to prove this case.

You state that your pizza was made with "poison". What poisonous substance was in the pizza? How do you know that the substance was poison. How do you know that the substance was poisonous?
If you have not filed a police report with the police in the city and county in which the incident occurred, then, in my professional opinion, if I were in your position, I would report this incident to the police. Whenever the penal code is involved, only the District Attorney (i.e., the attorney for the "People" of the State of California) can file a charge or charges against a person, person, entity, entities, etc.
