My wife got pulled over for speeding around 1am and the officer told her her license was suspended that very morning and could not drive the car home. My wife told the officer I was coming to pick up the car home. The officer was rude and didn't wanna hear my wife. I got to the scene and parked in front of my wife's car and was walking towards my wife's car, the officer told me to get back in my car and move away from the scene to the nearest gas station which i complied. I sat at the gas station for good 20 mins before the tow truck got to the scene and towed my wife's car away. I had to pay money to the tow company this morning to get the car out.
Now can I sue the police department for towing the car and not allowing me drive it home?
Anyone can sue but quite honestly based upon the info you've provided it's highly unlikely that you will prevail and if you do your damages appear neglible.
