May 2019 moved to the back house after living 5yrs in the front house, and just found out two weeks ago that the unit is illegal, originally it was one 3bedroom house with two bathrooms. But he built a wall splitting it into a 2bedroom house and a 1bedroom house. I found out because I have been having financial problems and asked him for the letter that declares how much I owe him for my social worker to help me. He refuses but he is constantly harassing me infront of my two children 5yr old and 8yr old, is verbally kicking us out. I'm a single mother. I owe him only $400 of November and this month of December ($800). I thought the units in the back were legal since the tenant had been renting the back house 2bedroom portion for over 10+years and the landlord with his family been living in the back house 1bedroom portion all that time. This means he has not reported the rent he received for the back house to the IRS. Can I report him for Fraud to the IRS for not reporting the income he received from the back house he rented?
You are likely living in an illegal dwelling. Contact the Los Angeles Housing + Community Investment Department to find out if it is an illegal dwelling. If so, you will be entitled to substantial relocation assistance and possibly refund of the illegally collected rent. See my case Carter v. Cohen, 188 cal.app.4th 1038 (2010).
