I was about too cook the green peas, when I pour it to the pot I found the worm. I showed my 7 years old niece and she also said it was a worm. I bought the can in February 2017. I always check the expiration date but in the both can of green peas I have does not have an expiration date.
What damages did you suffer as the result of a worm in the can? No damages, no use filing suit.

Return the can to the store where you purchased it - with the worm, if you still have it - and ask for a replacement or a refund.
No injuries or proof of emotional distress so litigation would not be your best avenue I think. Case law indicated that a woman who drank fecal matter that was found in her milk from a mouse in the warehouse it was packaged was not entitled to emotional distress.
