I assume Table Mountain Casino is an Indian casino--looking at the website, it definitely appears to be. One of the major problems you will face is that the accident took place in a foreign country. Indian casinos are subject to tribal law only--not California statutory law or federal law. As such, there are one or two adjusting companies that service the casinos--Tribal First is one. A lawsuit must be filed in the tribal court, although some casinos have provisions for arbitration, not trial. I have handled 2 Indian casino cases. I have been practicing law for 47 years. I will never become involved in another one ever again, and you may have trouble finding an attorney to handle the matter.
More information is needed to determine whether you have a viable claim. If, when you fell, the automatic shutoff was not triggered, it could be a problem with the escalator. If there was no way for the shutoff to be triggered based on your fall, it may be a touch case. You also need to have sufficient damages to justify suing them. If your injuries were resolved with a bandage, it may not be economically feasible to pursue a claim.
