You certainly should consult with an attorney who handles personal injury cases of this type. You should also try to find someone who is experienced in lawsuits against state agencies. In general, you cannot sue the state like you could sue an individual. There are many restrictions limiting your ability to sue the government. Another potential problem you may face is that the statute of limitations may have already run out. In other words, even if you could sue and have a great case, the time limit to file such a suit is likely expired. But as I said earlier, you need to talk to a lawyer experienced in these areas. You could contact your local bar association or the State Bar of Texas for referrals.
You may have a statute of limitations hurdle, but have a local lawyer investigate. Avvo has a great lawyer finder tool to locate an attorney close to your home. Good luck.
Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals.
