I became sick at work due to heat exhaustion that started to affect my kidneys. I was hospitalized. I was not able to return to work without doctors note. Well I was cleared to return to work without restrictions by the doctor and when I went to return to work the employer had discharged me.
I am sorry to hear about your situation. Did you report this heat exhaustion iincident to your employer as a Worker's Compensation accident? If you have not, it should have been reported that way. There is specific case law that accepts heat exhaustion as an on-the-job accident. If it has been accepted as a workers comp accident, you could file a potential suit for Worker's Compensation retaliation. There's a section of the workers comp act it says you cannot discharge someone due to their pursuit of Worker's Compensation benefits. I've done several of these kind of lawsuits over the years. I strongly suggest that you find an experienced workers compensation attorney who also handles this sort of wrongful termination. It may be hard to fine, but some of us do do both of these kinds cases in the Central Florida area. I'm suggesting you find an attorney who does both because there will be a lot of interplay between the two actions. The consultation would be free. I hope this is helpful for you.
