My wife and I have lived in the same apartment for 8 years and never had an issue. 3 months ago someone from California purchased our apartment complex and is turning the place next door into an AirBnb and in doing so has turn our quiet peaceful place into a nightmare. They moved noisy neighbors out of the place next door(for the AirBnb) to the apartment above us, who eventually were evicted(for noise) at the beginning of the month. The mgmt company texts us constantly, has construction across the hall and above us going at all hours, workers smoking in hallways, leave junk in the hallways/basement and now they are taking my parking spot for the AirBnb(I have a slight disability, so I need an easy access spot). It feels like they are harassing us right out of the place. I've complained numerous times, all documented through text, also have pictures and video. Can I sue them for rent I've paid plus moving costs? Would I have a case?
You appear to be month-to-month. The nuisance you are experiencing is very unfortunate, but I am sorry to advise you that the landlord can expel you with only a 30-day notice then a district court action. Suing for ent would get you what 3 months of rent? Hardly worth the effort. Now, you may be able to escrow future rent by first giving written notice of the nuisances you are expeirnecing and then withholding it into a special bank account until the wrongfulness stops. But --- beware: since you are month-to-month tenants, you can be the greatest tenant in the world and you and landlord have a great relationship, but neverthless landlord can effectively require you to leave with a 30 day written notice!!!!
