I had asked my landlord 7 weeks prior to moving out to fix a growing mold issue coming from the other apartment in the house. After 7 weeks I had given notice that I would be moving out. I reminded the landlord and the rental manager about the mold problem 3-4 times during those weeks. Am I able to sue for at least 2 months rent and medical bills seeming that mold could have been the cause of my health issues?
You can sue for any damages that you can prove were suffered as a result of the landlord's breach of contract and/or negligence. If you lived at the premises the whole time, is unclear whether you could recover any rent (because you benefited from the use and occupancy of the premises during that time). Your health problems would need to be shown to connected to the mold AND the landlord's negligence, which requires a thorough and complex analysis beyond what can be accomplished in this forum.
