So for 21 years my dad has not been in my life and has not attempted to reach out to me and my brother, I hired a personal investigator to look for him and I was wondering if I can sue him for child abandonment even though he is not an American citizen? I would want for him to pay 21 years of not being in our life’s and for my mother who had to work hard to maintain us
No, you cannot do so under US law.
This is general advice. You are anonymous. If...
For what purpose? What is it that you want to accomplish with such a lawsuit? What kind of damages would you allege? If you are talking about unpaid child support, you do not have standing to sue for that. The right to child support was your mother's and if she never asked for it, never got a court order for support, there's nothing you are she can do about that now. Otherwise, if you are seeking some other type of damages, I'm not clear on what that would be.
