A couple of years ago my bank modified my mortgage because we were experiencing tremendous health and financial issues in my family (one death in the family almost followed by another, loss of business, taking time off of work due to illness). Since the modification the bank has hired an outside company to come by my property (where my family and I live) and take photos on a monthly basis without any warning to us. A few months ago this person drove unto my property to snap these photos. This has put my family under tremendous stress and fear, first for the safety of our children and second being nervous that the bank will change their mind and foreclose. We are thinking about contacting an attorney to protect our family. What should we do? Thank you for any advise you can give us.
You should contact an attorney in your area who is familiar with bank foreclosure cases. I would suggest contacting the Legal Aid Society of Milwaukee and/or Legal Action of Wisconsin. Both organizations are staffed by excellent attorneys and they have helped individuals in mortgage issues. I don't know if you'll qualify for their services, but you should check with them first.

Congratulations for getting a modification to your mortgage, those are tough to get. Rest assured that as long as you've been making your mortgage payments the mortgage company cannot throw you out of your house. It must file a foreclosure in state court, first. If you've made all the payments you're supposed to, that is an easy defense to foreclosure.
What I suspect is happening is that after you modified your mortgage the mortgage company failed to reset your mortgage status. This means the mortgage company is sending people to observe the property for preservation and get broker price option quotes.
