While shopping at Home Depot, a sales clerk came towards me out of nowhere while loudly shouting “Hey! What’s that you put in your pocket?!”. The humiliation did not end there. He physically accosted me & put his hands in my pockets, until he emptied them completely. I did not resist or fight this deranged sales clerk because I knew I had done nothing wrong. I was also scared, embarrassed, & in shock by what had taken place. The sales clerk was not a security guard. He behaved like a vigilante. I never granted him permission to touch me, let alone to aggressively pat me down & search me! He certainly did not ask for my permission as he unlawfully detained me for no apparent reason. This took place in an aisle full of customers, all stunned at what they witnessed. After realizing he was mistaken, he sheepishly walked away without so much as an apology.
Yes. See a local experienced attorney to evaluate your case.
It called an assault and while there may not be damages worth speaking of here it is worth a call to the police and to any licencing agency of the business.
