Aon Hewitt (administers benefits for my employer) was neglegent and failed to inform Healthnet my health insurance was valid. As such, a number of my medical bills were denied, unpaid and I was denied medication. As a result of me not being able to get my medication, another condition was exercabated. This has created undue stress and caused financial strain and anxiety. Please advise
You can certainly have a local insurance lawyer investigate. Avvo has a great lawyer finder tool to locate an attorney close to your home. Good luck.
Unless your employer is a religious or governmental entity a bad-faith claim is probably not in the cards, as state law is pre-empted by federal law -- the Employee Retirement Income Security Act (ERISA) -- for employment-based insurance coverage. You may well have a remedy under federal law, but unfortunately the federal remedies are quite a bit less generous than what might be available under state law, and even recovering those less-generous remedies is difficult because in many respects the deck is stacked in favor of defendants under current ERISA law. Based on your inquiry I would suggest consulting with a lawyer specializing in ERISA claims, as those sorts of claims are full of procedural traps which a non-specializing lawyer might not be familiar with. You might take a look at by blawg, ProblemIsERISA.blogspot.com, for additional information about ERISA. Thnanks.
I agree with Richard Johnston. I agree with Christian Lassen.
