So my son's father got our son insurance. We are not together and going thru a custody case. I have repeatedly to have that information. Either a picture of it or the numbers or put me on the list to receive that info through the company. He will not do it. And will not give it to me. I know that I have a legal right to know this. Can I sue the father for it if he continues to not give me the information
If you are speaking of health insurance, then the question is whether he was Ordered to provide it pursuant to a Child Support Court Order. If he was, then ask him for the information so as to prove it was provided. As that is a common provision in Support Orders, it is likely in your Order (or would be if you filed for child support).
Until there is a Court Order, he has no obligation to provides such information to you. However, if you are already in litigation, ask your attorney to try to get the information (so that there is not a need for fighting over that issue). If you don't have an attorney, ask when you get to Court. If he is providing insurance, then anyone caring for the child needs to know the basic information for any emergency.
