No charges were filed on anyone but me...and I am the only one that wasn't stealing from the company. I can PROVE this as well. The owner himself lies and takes payables checks and abuses his company cc to buy whatever he wants without turning the receipts over to his accountant for taxes on income.
Other employees were stealing on their cc's maxing them out, including the son who abused it 5-10k a month on strippers...the owner even accused his son of theft and called him a theif in an email to other employees...but nothing was ever done to anyone but me.
You have to first win your underlying criminal case. Then if you have evidence to support you accusation you may be able to file for malicious prosecution. The lawsuit should be the last thing on your mind until you are cleared of your charges. You need to hire a criminal attorney, immediately.
I am not intending this to be legal advice, because I don't know the particulars of your situation. Call me if you would like to discuss this or other isues.
