After being informed that my wife was cheating with a married man by the man's wife, I called my wife to inquire, during the phone call she said they were just freinds and to F.off!! She also said she do anything she needed to for me to be arrested...Would you believe several hours later multiple sheriff deputies arrived at my home and immediately took me into custody. I was a life long police officer, with no history of violence, my only mental issues was a case of anxiety with no obvious symptoms or past incidents. Was a total railroading with nothing meeting the criteria of being a danger to myself or others. Does the system suck or what?!!
If appropriate procedures were not followed, you may have an action for the false imprisonment. The issue will not only be liability but what are the damages? Other than being involuntarily sequestered, did anything else happen to you? Are you seeking counseling now as a result of the incident? Were you kept for 72 hours or were you released shortly after being taken because you were fine? Consult with a personal injury locally to see if there is value in pursuing a claim.
The answers given are limited to the facts as given and presumed by the answer itself. Without seeing actual written documentation or having a conference to more fully explore the issues, this short answer has only limited application. Make sure to seek legal counsel and provide all documentation to get assistance in making informed legal choices. [email protected], 305 377 1505
You should consult with a personal injury attorney in your area about whether you have a claim for false imprisonment or otherwise.
As the other attorneys stated, false imprisonment is a recognized tort in Florida. Most personal injury attorneys don't handle these types of cases, so you may need to call around to find someone who will.
