I went to urgent care on a Wednesday afternoon, with symptoms of a uti. The urgent care took a urine sample. At that same visit, the PA told me he didn’t see anything in my urine and was going to send it out for a culture. They sent me on my way. Saturday the same week I get a phone call from one of the secretaries stating I have something she can’t pronounce. So she spelled it out for me, turns out she says my culture was positive for MRSA. With no open wounds or any symptoms of the sort I freak out, they called me in some antibiotics to the pharmacy and say I need to start taking them right away that it’s serious. Monday comes around and I get sent home from work due to this result. I went back to urgent care to get my results paper, and they refer me to Urology. Same day I go to Urology I’m seen they order blood tests and do more urine tests and set me up to get ultrasounds done which already took place. I have a scheduled appointment to get a cystoscopy done. I’ve almost lost my job. I received my test results and everything tested for is in the green. Can I sue urgent care for misdiagnosis?
I'm sorry to hear about your incident - this has obviously been very stressful for you. From the limited facts you provided on this site, it does NOT sound like a "medical malpractice" case that warrants the process involved with filing a formal lawsuit with the court; however, it sounds like things should have been handled differently with you to avoid some potentially unnecessary stress and suffering you experienced.
I suggest you file a complaint with the medical board in your state and request an investigation be done. The Medical Boards of individual states have grievance committees where you can submit your grievance, which will usually prompt investigation into the problem.
Healthcare can only improve when patients and the community take action and report wrongful conduct and negligent healthcare to the appropriate regulatory state agency.
