I put the initial deposit $18600 to an escrow company. I cancelled the purchase contract with the seller and seller demanded escrow officer to sent the deposit to the seller. Escrow officer just disbursed the fund to seller without verifying the seller information and matching the seller's trust certificate. In fact the purchase contract/cancellation is invalid due to the identity of the seller is not proved. Later, I hired an attorney and he helped me to get back the full deposit from the seller. However, I paid the legal fee $4500 because of the escrow company negligence. Should escrow company responsible the legal fee $4500 that i paid?
No. Not unless there was a contract provision for attorneys fees, and then they are set by the court. It’s always less than actual fees.
legal fees are difficult to recover....but not impossible if you can prove gross negligence.
