I opened up a business account. They asked for more documents like ID/Passport, business account information, verification of address, etc.
I provided them a picture of my passport and sent them MD state tax and traders license as well as a letter from the state stating that my LLC is legally registered. They wanted a bank statement of my business bank account however I didn't have one yet because I just opened it. So I sent them a verified PayPal account information with my bank account info that was verified with PayPal.
They also wanted to verify that the items I was going to list and seek were:
1. My items
I sent them pictures of the items with my passport and proof of purchase.
I received an email today stating that my account had been suspended and restricted from selling indefinitely without a chance for appeal.
I called them and asked my my account was suspended and restricted and they told me they can't tell me but they had enough reason to do so.
My background is clean and my business has a clean record because I had just opened it. They also stated that they could allow me to sell because it was a new business. It makes no sense.
I set the practice area as Business. Maybe an attorney in that field will be able to help. This isn't my field, but I'm not sure you articulated anything that amounts to discrimination. The best course of action is likely to hire an attorney to review the documents and contact eBay on your behalf. Perhaps some documents can be prepared to bring your entity in compliance with eBay's rules. Or, perhaps after going into more detail, the attorney can determine if there is a basis to allege discrimination.
This is a general response that should not be considered legal advice. No attorney-client relationship has been formed. Please speak with an attorney in more detail about your specific situation.
From the facts you presented, I see nothing sufficient to make a legally cognizable claim. Discrimination is unlawful only if it is directed at a person in a "protected class," such as discrimination based on religion, sex, race, etc. Perhaps additional facts might disclose a case not evident in your posting. Businesses are not required to do business with everyone and are allowed to change their minds about doing business. Moreover, you would have to show that the alleged discrimination harmed you in a quantifiable way, which would be very difficult to do as a new business. Good luck to you.
