Hello, I ordered an expensive device online, it was delivered to by my state branch, I discovered it was a fake and a replica, I complained, they instructed me to follow protocols, they came and pick the device for quality check and all was done they still redelivered the fake item to me. I want to sue from their branch office here.
As long as the terms and conditions of the governing sales contract don't have a forum selection clause, you should be good to do so. If you're going this alone, in addition to breach of contract you might want to see if you can assert a viable Unfair Trade Practices and Consumer Protection Act claim, which could entitled you to treble damages. I would strongly recommend seeking a consultation with an attorney in your area.
