Can i sue a restaurant for not refunding my money for food i ordered on there to go app and did not receive but they charged my?

I'm sorry to learn of your difficulty. But I am afraid that the legal system might be more frustrating to you than your experience with this restaurant. Even a simple suit in Small Claims Court will take 6 to 12 months to resolve. So, your best bet is to be a bit more patient, and, if the matter is not resolved within the next couple of weeks, to go to the restaurant and CALMLY and POLITELY ask them to follow through with having a refund issued. This is a simple matter that can probably be resolved amicably. But, it you are more interested in causing a commotion, you may well be "going to jail" rather than having your problem quickly resolved. Your best option is to work with the restaurant.
