I was a manager at a fast food company and I had closed the store for the night, but the drive through stays open. A grubhub delivery person came to pick up an order but the doors were locked and I directed them to the drive through. They started yelling and someone who was using the restroom inside opened the door for the delivery person. I put my hand up and gestured him to leave where he then pushed me. This started a fight between us that led outside where his father and mother started assaulting me along with him. I lost my job because he tried to sue my fast food company and now hes trying to press charges. Can I also press charges and sue his company since he was the one who escalated the situation?
You can certainly press criminal charges but you would be unlikely to succeed in an attempt to obtain civil monetary damages against the the company. This is because the driver was not acting within the scope of his employment when he assaulted you.
