MY SON HAS HAD RECONSTRUCTIVE SURGERY ON HIS EAR THAT HE WAS BORN WITH A DEFECT. AFTER 6 SURGERIES THE ENT SAID HE WAS DONE AND IT LOOKED HORRIBLE. SOMEONE REFERRED ME TO ANOTHER DOCTOR WHOM SAID IT WAS BAD BAD JOB.. HE HAS REDONE 98% OF THIS DOCTOR MESSUPS SHOWED PICTURES. WENT TO THE HOSPITAL TO FIGHT IT AND THEY SAID IT WAS DONE CORRECTLY THEY WILL NOT DO ANYTHING. I HATE TO SUE BUT I FEEL THIS DOCTOR SHOULDN'T BE DOING THIS TO KIDS

Per the other lawyer's comments, The Utah Medical Malpractice Act does require that a medical expert review the medical records and testimony in the case and be able to testify that the doctor's work in the case fell below the standard of care required of physicians in the area. Now, that expert need only base his/her opinions on a reasonable medical probability. That expert must also be willing to testify that your son's condition was also caused by the physicians negligent conduct compared to some other cause of the condition.
Once liability is shown, your family would be entitled to all medical bills generated to correct the damage this doctor caused. Your son would be entitled to damages for everything he went through by way of pain and suffering as well. A claim can be made for everything you went through, but that damage claim depends on the facts of the case and may not exist depending on the circumstances.
