Was arrested with a broken arm. I was denied my temporary cast. I was incarcerated for 11 months and only had 1 x-ray where I was told the bone healed back together. I also was on a top bunk. I was then transported to DOC where I found out the bone was still broken and I had surgery and I now have a 10 inch plate and 8 screws in my arm.
Possibly. If you can show that the failure to properly diagnose somehow caused additional injury. There are other aspects that you should explore with an attorney as well such as violations of civil rights claims but be advised that in claims against the State, County or any other government entity there are laws that limit time frames to bring claims or limitations on damages. You should fully discuss the issues with an attorney. Best move on your part is to request your prison record including all medicals and x-rays AND get your chart from the doctor that did your surgery and bring them to the attorney to review. It will save time.
