My wife and I came home recently from morning appointments to find a Charter Communications cable lying on the ground in our front yard without having received any prior warning from Charter. Apparently Charter had installed the cable as a temporary fix to connect the cable box in our yard with a house getting new service 2 doors down from ours. The cable runs through a grassy portion of our yard, across a sidewalk, and then for about 50 feet along the side of a road before reaching the house with the new connection. Although the cable is visible in the sidewalk and road, the portion of the cable in the grass is hard to see. My 73-year-old wife tripped over it as she was walking through the yard to inspect some of our bedding plants. Neither Charter nor our neighbor had forewarned us of the presence of the cable, and my wife may have been injured by the fall, although we are not sure yet about the extent of her injuries. We immediately contacted Charter, and they have promised to address the issue, but the cable has remained unburied for several days now. We live in an HOA community that has utility easements, and we are unsure about what rights we have under TN law.
Your Wife may have a cause of action against Charter for negligence based on their placing the cable in such a manner that it was foreseeable that someone could trip over the cable.
