My father just got sick and is not able to get out of bed due to the cancer. He and my step mom have been together now for 30 years and he would like to marry her before he passes. I'm his power of attorney because he is no longer allowed to make his own decisions.
This would depend upon what particular powers your father's POA has given you. Assuming he has given you a broad POA then you should be able to sign the marriage license. You need to look at the POA and see if the conditions of the POA effectiveness been established. Was the POA in effect from day he signed it or was there a triggering event e.g. his incompetency which makes it effective (durable POA)
I don/t know the answer to your question, but why dont you arrange for a wedding in his hospital room? I dont see any reason why that cannot be done. Talk with the
hospital social worker.
