if you are getting a Administrative Separation from the U.S. navy with a General (with honorable condition ) for pattern of misconduct , are you able to sell your remaining leaver.
if so can you please cite the reference, I have been looking for it all over the internet and I have not been able to find it.
If you are receiving a General Under Honorable Conditions, then you should be able to sell your remaining unused leave. If you are receiving a General Under Other than Honorable Conditions, then you cannot sell your unused leave. The supporting citation for my analysis is:
37 U.S. Code § 501 (a)(1) - defines what a "discharge is
37 U.S. Code § 501 (b)(1) - states that anyone who is discharged can sell unused leave
37 U.S. Code § 501 (e)(1) - states that General Under Other than Honorable Conditions cannot sell back unused leave
Hope this helps. Good luck.
