I got herpes and had settled outside of court because the doctor who infected me threatened to crush patients necks and cripple them and kill himself if I didnt settle. I have texts. His attorney drafted an agreement that I didn't want to sign but felt forced. I also did not get the money.
I don’t see any claim here against the lawyer was especially if it wasn’t your lawyer
You have no direct cause of action against the attorney. The attorney owes no duty to you as a client and does not guaranty performance of the terms of the settlement.
The above is general legal and business analysis. It is not "legal advice" but analysis, and different lawyers may analyse this matter differently, especially if there are additional facts...
If you were not paid, then you could either sue to enforce the agreement, or might be able to pursue the claims for the original claims.
Nothing herein guarantees, warranties, or predicts the result of any future legal representation. No attorney-client relationship is formed without the consent of the Law Offices of Todd Rash expressed in a written retainer agreement. Some of the answers here on Avvo may include questions that the attorneys hope you will answer by messaging them directly to them in hopes of establishing a relationship with you that will result in you hiring them. State law and Avvo rules prohibit attorneys from soliciting potential clients for business.
Apparently you did not have counsel of your own or did not seek counsel of an attorney in moving forward and presenting your case. If this is not correct, I would contact your attorney representing you in this matter. While I would recommend you now do contact an AVVO qualified attorney to discuss this entire matter, from the information provided, it appears the attorney you speak about represented the Doctor involved and therefore owed the Doctor a fiduciary duty. Much more must be learned to potentially gather that this attorney (representing the Doctor) actually owed you a duty during negotiations in this matter. Take along your entire file on the matter including the settlement agreement, emails, etc., when you contact counsel. Most attorneys will provide for an initial consultation without charge.
Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals.
