I was in an accident with my two children July 1st. It involved two other vehicles. I was at a stop light waiting for the light to turn. The vehicle at fault hit another car, and that car hit me then the at fault vehicle hit me after the fist one. This person was cited at the scene by police. My car was totaled by my insurance but this persons insurance tried to simply repair it. They have finally stated they will total it, but have not paid it off. I have been in a rental vehicle but I just discovered that the insurance company for the driver has stopped paying for the rental. We have had to handle much of the issues that have come up because he is just not responsive to us or the ins. company. He was sent the info that the rental payments were going to stop. Didn't share the info. I am not able to get a new loan so I will not be able to get into another vehicle. The at fault driver has his new Camero and so far I am left without anything, this attorney says, "oh well." If not for his negligence I would have my perfectly maintained car and the established loan. Can I fire my attny for failure to perform his duties?
Yes, you can fire them. HOWEVER, they will have a claim to any funds that you receive in a settlement. Read over the contract that you signed with the attorney.
