As part of my divorce settlement in '03 I agreed to put 10k in an annuity for my kid's college. My lawyer at the time set it up, I assume with my kid's mom in control of it. Now that the kids are grown I've learned that there is no college money and my kids have no interest in even discussing it with their mother or even going to college to the best of my knowledge. Can I legally recover my contributed funds from the kid's mom? I have no idea what she spent it on or how long ago.
You need to talk to a family law attorney. If the $10K had been properly placed in an annuity it should have prevented any withdraws except for educational purposes.
