My husband initiated divorce proceedings against me over a year ago. I signed the notice of provided to me, returned it and the answer to his lawyer. Now he has fired his lawyer and will not respond to my calls. The papers have not been "officially" filed with any clerk of court. My attorney has sent papers ot him asking him to dismiss his case and allow me to proceed with filing the divorce proceedings in my home county. He will not respond to my lawyer's requests. Is this case legally considered "filed"? Because he is refusing to cooperate, can I petition for divorce? Basically I'm "stuck" and can't move forward at all if he refuses to communicate with me, my lawyer or his lawyer. Please help. I'm completely at his mercy unless I can bring a counter suit for divorce. Thx.
