New York State
I filed an OSC that was signed by the Judge.
The other party filed objection.
I want to file an objection to that objection
I also want to add some points I did not mention in the first OSC
Did the signed order set out their opposition time, your reply time, and and appearance date? It's hard to know exactly what you and the OSC are trying to do without reading the OSC. In a typical motion there are your moving papers, their opposition papers, and your reply papers. Depending on the situation, an OSC might not provide you time for a reply before you have to appear in court. You can ask the judge for an opportunity to reply when you appear in court, if you cannot otherwise fit it in before then. Your reply is limited to responding to their opposition, not changing or adding new or different arguments.
This response does not create an attorney-client relationship and is not intended to provide legal advice for your specific situation.
An OSC is different than a motion in that unless itis built in to the order, you don't get to reply. Even if you do get to reply, the purpose of a reply is to respond to the other side's arguments, not to add new points that you should have put in your original papers.
